Collective and Certification Trade Marks

Collective and Certification Trade Marks

Collective trade marks are used by members of an association to indicate they are part of a collective. e.g. Master Builders logo - MB member.

Certification trade marks indicate that the goods or services meet certain requirements or qualities set by the owner. The owner as the certifying authority cannot trade in the goods or services that the trade mark is used on. e.g. the NEW ZEALAND MADE red kiwi logo Buy NZ Made Campaign or the internationally recognised Woolmark.

We can assist our clients with the fling of their collective and certification trade marks in New Zealand and Australia and internationally as required.

Leighton was the instructing solicitor and successfully represented Omega Flex Limited in highly contentious proceedings reported as O/765/18 against BSI Group (also known as the British Standards Institution) relating to the famous BSI Kitemark certification trade mark before the Registrar at the United Kingdom Intellectual Property Office.
